Notice is hereby given that the ZONING HEARING BOARD will have a special meeting on

for the purpose of hearing the following appeal.

Appeal of Bethlehem Manor Village LLC for a use variance to construct three (3) 44’ tall apartment buildings, totaling 96 dwelling units, in an Institutional Zoning District; this is a prohibited use. The applicant’s site plan indicates that 25 dwelling units per acre are permitted, however this is based on the # of beds in the previously-approved 125 bed Personal Care Facility conditionally approved by the City Planning Commission in November 2008. The applicant is challenging the Zoning Officer’s determination that a 49’ front yard setback is required for Multiple Family Dwelling structures, and in the alternative is requesting a dimensional variance of 29’ on both Center Street and Dewberry Avenue to allow a 20’ front yard.
