Notice is hereby given that the ZONING HEARING BOARD will have a meeting in TOWN HALL, 10 E. Church Street, Bethlehem, PA, on Wednesday June 23, 2010 at 7:00 PM, for the purpose of hearing the following appeals.

ALL APPLICANTS MUST APPEAR AT THE MEETING

1. 813 Main Street
Appeal of Nicholas J. Bozakis for a variance to have a second primary use on the property, a dwelling above an existing 4 bay detached garage, and dimensional variances from the table of area, yard, and building regulations for the proposed use. The property has an existing four (4) multi-family dwelling on the property, approved by the Z.H.B. in 1982. Required total development area for the five (5) units – 16,000 square feet, proposed 9643.25square feet; required rear yard setback – 20’, proposed – 12’; required side yard setback – 6’, proposed 2’. 2. 746 N. New Street
Appeal of Gregory and Sarah Berger for a special exception to expand an existing lawful non-conforming automotive repair garage use. Allowable expansion – 50% or 779 square feet, proposed – 49.7% or 775 square feet. (Articles 1310.02 (pg. 43), 1323.02.b (pg. 152), 1323.04.a.1 (pg. 152), 1325.07 (pg. 160))

3. 1755 Center Street
Appeal of Jan and Helena Hudsky for a dimensional variance from the side yard setback to reconstruct and convert the existing 12’ X 21’ three season porch and construct a 132 square foot addition to allow for a 396 square foot family room attached to a single family detached dwelling. The existing building is a lawful, non-conforming structure.
The applicant meets the allowable 50% expansion for the non-conformity with a 17% proposed increase of the non-conformity; however, the west side yard setback is not the required 13.5’. Appeal of Jama Properties, LLC for a use variance to subdivide a vacant property into two lots and construct a single family semi-detached dwelling on each lot. The proposed area, yard and building regulations utilized would be for the RT Zoning District except for the required width.
