Notice is hereby given that the ZONING HEARING BOARD will have a meeting in ROOM B-504, 10 E. Church Street, Bethlehem, PA, on Wednesday November 18, 2009 at 7:00 PM, for the purpose of hearing the following appeals.

Appeal of Richard Campbell for a dimensional variance from
the maximum allowable building coverage to construct a one-family
semi-detached dwelling. An existing garage is on the property.
Allowable building coverage – 35%, Proposed –
43.5% (Articles 1307.02.a.2, 1307.03, 1318.01, Table A-2,
1325.06)

Appeal of Raj Saraswati for a variance to alter the former
plan approved by the Zoning Hearing Board on June 6, 2007,
A Dunkin Donuts with gas pumps. Applicant requests a variance
to increase the height of the non-conforming free standing
sign from 25’ to 26.5’. This proposed sign above
the gas price board will decrease from 42 square feet to 37
square feet on each side. The applicant also requests to alter
the parking on the west side by removing two spaces in front
of the drive-thru lane, and increasing the spaces nearest
the west property line by 3, and relocating the trash dumpster.
A dimensional variance is required for the setback between
the parking spaces and residential property line. Required
setback – 10’, proposed – 4’8”;

Appeal of Elliot Avenue, LLC requesting an interpretation,
pursuant to Article 1325.05, as to whether the one year time
period set forth in Article 1325.05 applies to an earlier
interpretation of the Zoning Hearing Board, dated June 7,
2008. In the alternative, the applicant requests an interpretation
pursuant to Article 1325.05, that the existing slopes greater
than 15% on the property have been altered and man-made, and
a reasonable estimate of the natural slope is less than 15%
to permit the land development. (Articles 1325.05, 1318.29,
