Notice is hereby given that the ZONING HEARING BOARD will have a special meeting in Town Hall, 10 E. Church Street, Bethlehem, PA, on Wednesday, November 15, 2006 at
7:00 PM, for the purpose of hearing the following appeals.

ALL APPLICANTS MUST APPEAR AT THE MEETING

1. 1125-1127 Maple Street
Appeal of Michael Young to request an interpretation that no relief is necessary from the otherwise required side yard setback or maximum building coverage requirements to occupy the front portion of the first floor of an existing structure with a one bedroom apartment because the building is existing and the footprint of the building is not changing. In the alternative, the applicant requests variances from side yard setbacks (20 feet required; 5 feet proposed) and maximum building coverage (40% permitted; 60% proposed) In either case, applicant requests variances from the total development area (6,000 square feet required; 3500 proposed) and lot area per dwelling unit (2,000 square feet required, 1166 proposed). Applicant also requests an interpretation that the additional proposed parking is sufficient to accommodate the third apartment. If the interpretation is not granted, the applicant requests 5 spaces instead of 6. Variances, as necessary, from sections 1319.03(b), (f) and (h), Design Standards, are also requested.

2. 815 Pennsylvania Avenue
Appeal of Bethlehem Area School District for a variance to extend the use of the temporary modular buildings for one (1) year for an alterative educational program which includes high school level, and a variance from the required number of parking spaces, and a variance from the parking design standards and screening for the temporary off-street parking lot. (Required number of parking spaces for a high school level-100, proposed-34, required parking space depth – 19’, proposed – 17.5’; required aisle width – 25’, proposed – 19’10’’ and 21’, proposed screening – none. Articles 1319.a.16, 1324.01.i, 1319.03.a.2, 1319.03.a.4, 1319.03.h, 1325.06)

3. 924 Eaton Avenue
Appeal of Sovereign Bank for the following dimensional variances:
(1) to locate a drive through bank facility closer than 250’ from a dwelling – proposed – 55.3’; (2) to locate the bank facility (including drive-through) closer than 100’ to the residential zoning district – proposed – 23.28’; (3) to locate the garbage dumpster and loading area closer than 70’ from a residential district – proposed dumpster setback – 60’; proposed loading area setback – 10’; (4) to locate a temporary bank trailer less than 100’ from a residential district – proposed – 35’; and less than 15’ from the right of way (ROW) of a public street – proposed – 6’; (5) to have less than an 8’ wide landscaping planting area abutting any street (North side)- proposed-3’; (6) to decrease the number of required deciduous trees required on the street and in a parking lot, and the size of the vegetated area around the parking lot tree; (Articles 1314.B.02.a (II) refers to subsections (b) (1) (VI) (iii); 1314.B.03.a.3.I****; 1314.B.03.a.9, 1314.B.04.b,c,1325.06)

Appeal of Arleen Wright for a special exception to operate a group daycare in the home. (Article 1308.02.c.1 refers to 1306.02.c.3., 1325.07)

5. 507 Taylor Street
Appeal of Suxing Wu for a dimensional variance from the required visibility sight triangle where a driveway intersects a public street for the purpose of installing two parking spaces on a property. (Articles 1318.06.b, 1325.06)

6. 218-226 W. Union Boulevard
Appeal of Mark Hanna and Bettina Castagno for a use variance to operate an open-air market on limited days and hours between March and December. (Articles 1307.02.a., 1325.06)

7. 724-726 E. Fifth Street
Appeal of the Affordable Housing Alliance for dimensional variances from the Area, Yard and Building regulations to create a two-lot subdivision, with lot 1 (726 E. Fifth) having an existing warehouse and one residential use, and on lot 2 (724 E. Fifth) will be constructed a Single Family Detached Dwelling. (Articles 1308.03 refers to 1318.01, 1318.03, Table A-2. required minimum side yard setback on each side of (lot 1) – 4’, proposed – 3’ and 1.5’; for (lot 2), required minimum side yard setback 5’ one side, proposed – 1’; required minimum lot width for each lot -30’ for each, proposed – 20’’; required lot area per dwelling – 3,000 square feet, proposed 2,800 square feet for each lot)
