Notice is hereby given that the ZONING HEARING BOARD will meet in Town Hall 10 E. Church Street, Bethlehem, PA, on Wednesday, July 26, 2006 at 7:00 PM, for the purpose of hearing the following appeals.

ALL APPLICANTS MUST APPEAR AT THE MEETING

1. 109 W. 4th Street
Appeal of “Four Star Properties” for a use variance to change a mixed use residential/commercial property to an assisted care facility. (Article 1325.06)

2. 1335-1337 E. 4th Street
Appeal of James W. Bethea, Jr. for a use variance and a variance from the off-street parking requirements to occupy the vacant (abandoned) and formerly non-residential building use with a grocery store and install a 8 sq. ft. unlighted wall sign (Article 1308.02.a, 1319.01.a.22, 1323.06, 1325.06) Required parking spaces – 4, proposed – 0, due to the existing condition and non-conforming no available parking on the lot, the property is credited for 2 spaces).

3. Silvex Rd. near Route 412 & Interstate Route 78
Appeal of J.D.M. Materials Company for a special exception to operate a temporary portable concrete plant on the property. (Article 1316.02.c.1, 1325.07)

4. 314 Filmore Street
Appeal of Victory House of the Lehigh Valley for a variance to expand a lawful non-permitted homeless shelter and residential treatment facility. This existing use was granted approval by the ZHB in 1994. (Article 1317A.02, 1325.08.j and k, 1325.06) Record Lot -- .390 acres IR – Industrial Redevelopment Zoning District

5. 114 W. Morton Street
Appeal of Bethlehem Area School District for dimensional variances from the building setbacks (the building’s proposed average height of 60’ determines the yard setbacks); the clear sight triangle, and the off street loading facility design to construct a new “Broughal Middle School”. (Articles 1309.02.b, 1309.03, 1309.04, 1318.01, 1318.06, 1318.07, Table A-3, Footnote 6, 1319.a.3, 1319.05.a.5, and 1325.06) Required setback – 20’, proposed – 0’ on Vine St., 8.65’ on W. Morton St.; Required sight triangle across a corner-25’, proposed-approx. 20’ at W Morton St.and Vine St.; Maximum allowable driveway width for a loading area – 35’, proposed – 50’ with the proposed off-street loading zone being a temporary impediment to traffic).

6. 652-658 and 660-662 State St.
(These are two appeals involving one owner, similar in nature, involving 2 lots fronting on an alley. Also proposed is a lot line adjustment)
Appeal of Stonecastle Developer, LLC. for dimensional variances on 2 lots from the steep slope requirements and constructing a dwelling on each lot which faces an alley, and a variance from the merger Article 1323.12 for 2 non-conforming lots. (Articles 1302.03, 1302.55, 1302.86, 1318.29, 1318.29.c, 1325.06, Required lot area for lots 1 & 2 – 10 acres, proposed lot 1- 7800 sq.ft., lot 2- 11,700 sq. ft.; max. allowable impervious coverage – 5%, proposed – lot 1-22.19%, lot 2 – 19.46%
